CASH AVENUE TERMS OF SERVICE
IN A NUTSHELL:
~ YOU MUST BE ABLE TO READ ENGLISH AND UNDERSTAND THESE TERMS. Failure to understand these Terms says to me that you can't read English and therefore - you are in violation.
~ Only one account per household.
~ Please be able to understand English.
~ Please be active (See definition below).
~ Don't cheat (See definition below).
ACTIVITY REQUIREMENTS:
Free Members: Must click 1 link every 30 days (calendar month - click climber) to keep from being suspended.
Free Upgrade: Must click 50 links every 30 days (calendar month - click climber) to keep their Free Upgrade. Failure to do this will result in your Free Upgrade being removed.
Paid Upgraded Members: Must click 1 link every 30 days (calendar month - click climber) to remain active.
Affiliate Page Owners/PTP Users: Must click 150 links every 30 days (calendar month - click climber). Failure to do this will result in your earnings for that area for that month being deleted. This is tracked and not negotiable. Please see Affiliate Page section below.
30 Days Inactive - Your account may be suspended without warning.
45 Days Inactive - Your account may be deleted without warning.
PAYOUT GUIDELINES:
All members: You will need a minimum of 150 clicks in order to request payout. Payouts are made to those whose accounts are in 'good standing' and will be monitored for cheating. Payouts will be made by Paypal Masspay and Alertpay only at this time. Masspay fees apply for Paypal, but you will not be charged the normal receiving fee from them since I pay using Masspay.
Affiliate page owners and PTP users:In order to request earnings earned from downlines, affiliate pages, and ptp, you will need 10% in personal earnings. Now to help offset this, I will include the usual of paid to clicks and paid emails, but I will also set it to include your CONTEST PTC WINNINGS. I chose to add this item in to help offset the 10% since this item is honestly earned.
Please limit payout requests to $6 maximum so that these can be processed immediately. All payout requests will be processed within 30 days, or a reasonable time there after. Normally within one week.
If you have more than 3 cheat links clicked in any calendar month and request payout, your request will be canceled and you will not be paid that month.
AFFILIATE PAGE OWNERS & PTP USERS:
This is an 'extra' option to earn...not the ONLY one. Therefore you must stay within the 'Activity Requirements' listed
above. Failure to do so will result in penalties and possibly your Affiliate page being suspended for 30 days (without prior notice)
and (this is for ptp & affiliate page owners...) possible account/affiliate page suspension or deletion. The penalty breakdown is
listed below.
IF DURING ANY 6 MONTH PERIOD you fail to meet the activity requirements:
1st time - $.25 cents will be deducted from your account.
2nd time - $.50 cents will be deducted from your account and your affiliate page/ptp privledge will be suspended for 30 days
without warning.
3rd time - $1.00 will be deducted from your account and your affiliate page/ptp privledge will be suspended for another 30 days
without warning.
4th time - Your affiliate page and/or PTP privledge will be removed permanently. There is also a chance that you will NOT be
able to withdraw those earnings, but use them for ads only.
These Terms are NOT Negotiable.
MISCELLANEOUS INFORMATION:
We will be blocking all Proxy IP's, College IP's, and all other "TYPES" of routers of that nature. If you are using one of these methods, your account will be deleted.
We will no longer accept email addresses that continually bounce emails, including, but not limited to Yahoo.com, hotmail.com, and AOL.com. Gmail is a wonderful alternative if you need to know about one.
If your account is set to inbox only for bounced emails, it needs to stay that way or change your email address. If you keep changing it back without fixing the issue, we will be forced to suspend your account until the issue is resolved.
CHEATING:
Cheating of any kind will NOT be tolerated. This includes, but is not limited to,
*Getting past the Member Verification process and clicking ads when not from an allowed country. Immediate deletion of your account.
*More than 1 account per IP/household - accounts will be checked for validity and those in violation will be deleted.
*Complete gibberish and/or incomplete information on your profile page. This means you can't read & write English and will be deleted.
*Clicking MORE THAN 3 cheat links in any 30 day period. Your account MAY be suspended or deleted.
*Clicking MORE THAN 10 bad turing numbers in any 30 day period. Your account MAY be suspended, deleted, or penalized.
*Any visit to a bot trap page. Immediate deletion of your account.
*3 failed English Tests within a 30 day period. Your account MAY be suspended, deleted, or penalized.
*Bad Keyword Selections. This means you can't read & write English and your account MAY be suspended, deleted, or penalized.
*Continual submit (more than 3) of a 'banned site' for advertising. This means you can't read & write English and your account MAY be suspended, deleted, or penalized.
*Continual submit of 'unacceptable advertising' will get your account deleted.
*If you are found to be using any type of BOT or auto clicking software, you WILL be deleted.
Your account may also be suspended (with personal message from admin) if you have received a personal message from admin about fixing certain items in your profile or other area and fail to either fix the issue or contact admin within the specified time period.
ADVERTISING GUIDELINES:
Use your head people. I will accept advertising for almost any type of business BUT nothing that will directly harm another member. If your site contains something that I can't view in front of my children, it WILL be deleted, and you MAY OR MAY NOT get your redemption or purchase returned. Please don't submit advertising for a site that takes way too long to load, and has too many affiliates. Ads submitted which contain viruses or other warnings, will NOT be processed and you WILL NOT get your redemption or purchase refunded. There is normally an updated banned list on the site. Please view this before submitting ads as to not lose your redemption or purchase.
Responsibility of other Webmasters/Program Owners: Effective June 1, 2009 -
If you require 10% (or more) in personal earnings vs. ptp/affiliate page earnings at your sites, this will apply here.
You will hold yourself to the same acceptable standards that you hold your own members to.
If you require 1 email every 15 days at your site to remain active, then that applies here also.
If you have a $3 maximum per request per 30 days at your site, then that applies here also.
I didn't want to do this but there are too many sites out there that require 10% (or more) in personal earnings (which I do NOT mind,
I understand the need for it due to the abusers) but what I don't understand is how you can have only 43 ptc's for your members
to click on (and this is their Terms and they chose to not have the ads available for members to click on).

We are NOT A MLM OR GET RICH SCEME!!!
By signing up and actively using the this program you agree to all terms and conditions set forth in this agreement. We may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with us. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in this program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
Responsibility of Members:
You must be 18 years of age or older to participate in this program. Our program is open to Tier 1 & 2 Members only.
You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing account.
You will use your email address/password combination to access your account. It is your responsibility to keep this information confidential. You may change this information by logging into your account and following the
"User Account Info." link.
You are solely responsible for any and all use of your account including authorization by you to any third party individual who may use your account.
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by us be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination.
You must maintain your e-mail account that you used when signing up with us. You agree to receive e-mail advertising from us.
In the event your e-mail account on file becomes closed or blocked to messages from us, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination.Auto-responses will also be deleted immediately.
The use of any form of automatic clicking programs IS STRICTLY PROHIBITED!! If you are found to be using so called "CHEAT WARE", your account will be IMMEDIATELY terminated with forfeiture of All earnings to date of termination.
EFFECTIVE IMMEDIATELY-- If you are found to have come from, or be promoting a site that encourages the use of the so called "CHEAT WARE", your account will be IMMEDIATELY terminated with forfeiture of All earnings to date of termination.
Relationship of the Parties:
You are independent contractor, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between us. You understand that you do not have authority to make or accept any offers or make any representations on behalf of this site. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.
Limitation of Liability:
We will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or our program, even if we have been advised of the possibility of such damages. Furthermore, we aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by us. Members may earn by referring new members to our program. Members will be paid via PayPal/Alertpay/U.S. Money Order/(evowallet when available). We will pay members when their balance reaches the minimum payout rate set by us. Once the member has reached payout they may request payment with a max of $6.00 each time. Payments will be made within 30 days, or a reasonable time after. Accounts will be scanned for activity, simply logging in without any clicked links will not constitute activity. Accounts found to be inactive requesting payment will be terminated.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with us and may result in legal prosecution. We strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. We may charge up to $5 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. We will file charges for recovery of any earnings received from multiple sign-ups.
Vacation mode:
When you put your account on vacation you also need to take it off when you come back. Accounts that are on vacation or inactive do not get payouts requested or randoms. If you plan on being away over 30 days then you need to contact support and let me know so that your account will be flagged and it does not get deleted.
